Under § 176 StGB the older partner is liable to prosecution.

Sex is allowed! But beware! With restrictions!

Because the aim of § 182 StGB under the heading “Sexual Abuse of Youths” (“Sexueller Missbrauch von Jugendlichen”) is specifically to further consolidate development and sexual self-determination in young persons. This means any person who exploits their partner under 18 years of age in sexual self-determination or pays them for sexual acts or exploits a coercive situation, i.e. a relationship of dependency or trust, is liable to prosecution (a large age difference is often an indicator of this)!
